Terms and conditions

These are the terms and conditions of ISANIZE, the registration portal of Stichting ISAN NL (Lekerweg 8, 1609 GE Oosterleek, The Netherlands, info@isannl.org), the Dutch registration agency appointed by the ISAN International Agency. They apply to every use of ISANIZE: an account, an ISAN registration, searching the registry, the catalog, matching and a membership. By creating an account or ordering a service you agree to them.

1. ISAN and the ISAN Terms of Use
ISAN is the international standard (ISO 15706) for the identification of audiovisual works. The ISAN registry is managed by the ISAN International Agency (ISAN-IA) in Geneva. ISAN NL assigns numbers on behalf of ISAN-IA. Every use of ISAN numbers and ISAN data is therefore also subject to the ISAN Terms of Use of ISAN-IA. Their main rules are set out below, translated to the Dutch situation. Where the ISAN system itself is concerned and these terms contradict the ISAN Terms of Use, the ISAN Terms of Use prevail.

2. Your account

• You enter correct and complete details and keep them up to date. Invoices go to the details in your account.
  
• You keep your login details to yourself. What happens through your account is for your account, unless you told us at once that your login details were in the wrong hands.
  
• If you order as a consumer, you agree when ordering that we perform the service right away. Your right of withdrawal lapses as soon as a registration has been sent to ISAN or a matching has started.
  
• We may close an account in case of abuse, non-payment or use contrary to these terms or the ISAN Terms of Use.
  

3. ISAN registration

• You warrant that you are entitled to register the work, as producer or rights holder or on their behalf, and that the details you enter are correct.
  
• By registering a work you grant ISAN-IA, as the ISAN Terms of Use provide, an unrestricted, unremunerated, irrevocable and non-exclusive worldwide right to use the metadata of the work in perpetuity as part of the ISAN system. Your rights in the work itself remain fully yours; ISAN-IA and ISAN NL claim no right whatsoever in the work.
  
• ISAN-IA checks whether the work already has a number and assigns the number. An assigned ISAN is permanent: it cannot be withdrawn and cannot be moved to another work. If the work turns out to have an ISAN already, you receive that existing number.
  
• A registration that has been sent to ISAN is not refunded, also when you no longer need the number.
  
• You change the details of a registered work through your catalog. The ISAN registry is and remains the only authoritative source of the ISAN data.
  
• Bulk registrations, through a template or the API, are also subject to these terms. Quantities, rate and delivery time are agreed per assignment.
  

4. Use of ISAN numbers and ISAN data

• You may use an ISAN number freely: in metadata, credits and contracts, in print, in your own databases and in exchanges with distributors, platforms, broadcasters and collecting societies. You may distribute your own metadata with the corresponding ISAN numbers freely.
  
• ISAN data of others that you see through ISANIZE, in search, matching or your catalog, may be used in the ordinary course of your business, provided the ISAN number and its data stay together. You may not resell the ISAN registry or parts of it, or offer it as a database of your own: only ISAN-IA and the registration agencies provide official ISAN lookup services and copies of the registry.
  
• The right to use ISAN data obtained this way survives the end of your membership or account.
  

5. Search and catalog

• ISANIZE shows the data from the ISAN registry as it is. It was entered by many different registrants. ISAN NL and ISAN-IA do not warrant its accuracy, completeness or fitness for any purpose.
  
• Which details of a record you see depends on your membership. Works of others that you link to your catalog remain registrations of that other party: linking registers nothing and grants no rights.
  

6. Matching
With the matching tool you look up which ISAN records belong to a list of titles. The terms of the matching service apply to it; you accept them with every order and they form part of these terms and conditions. In short: every match is judged by a person, you verify the result before you use it, ISANIZE does not warrant a complete or error-free matching, and a matching that has started is not refunded.

7. Membership

• A membership (BASIC or FULL) runs for one year from its start date and is invoiced in advance. It renews automatically for a year at a time, unless you cancel before the end of the current period, through your account or by e-mail. A year that has started is not refunded.
  
• What a membership includes and costs is on the rates page. If the content or price changes, this applies from the next renewal and we tell you beforehand.
  

8. Rates and payment

• The rates are on the rates page and exclude VAT unless stated otherwise. ISAN fees are, as the ISO standard requires, charged on a cost recovery basis.
  
• Registrations and matchings are paid in advance; the service starts once payment is received. Bulk registrations and rate agreements are invoiced as agreed.
  
• You can pay with the payment methods on the site (through Mollie) or by invoice where agreed, within the payment term on the invoice. If payment fails to arrive, we may suspend the service.
  

9. Intellectual property

• The marks ISAN and ISAN-IA and the ISAN materials are the property of ISAN-IA. You may use the name ISAN and the ISAN logo to display an ISAN number, for instance with the barcode from ISANIZE, but not in a way that suggests that ISAN-IA or ISAN NL endorses you or your product or is affiliated with you.
  
• ISANIZE, the site and the software belong to Stichting ISAN NL. Your rights in your works and in your own metadata remain yours.
  

10. Liability

• ISANIZE and the ISAN registry are provided as they are. ISAN NL works with care, but does not warrant the accuracy of data in the ISAN registry, the availability of ISANIZE, the ISAN registry or third-party services, or decisions you take on the basis of ISANIZE.
  
• The liability of ISAN NL is limited to the amount you paid for the service concerned, with as maximum what you paid ISAN NL in the twelve months before. This does not apply in case of intent or deliberate recklessness on the part of ISAN NL.
  
• You indemnify ISAN NL and ISAN-IA against claims of third parties arising from a registration or upload you were not entitled to make.
  

11. Privacy

12. Changes
We may change these terms. The new version applies to orders and renewals from its publication on this page; for a pending order the version at the time of ordering applies.

13. Governing law
Dutch law applies to these terms and to every use of ISANIZE. Disputes are brought before the competent court in the Netherlands, unless the law designates another court. The relation with ISAN-IA itself is governed by the ISAN Terms of Use and Swiss law.
